SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING ANY LOSS OF
PROFITS OR SAVINGS), WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL
THEORY AND WHETHER ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
