AOL SOFTWARE END USER AGREEMENT FOR

AIM

Your product includes software that will let you access and use the AOL Instant Messenger

(“AIM”) service. You may use the AIM software and features provided that you agree to

the following license terms.

BY USING AIM, YOU ARE SIGNIFYING THROUGH YOUR ACTIONS THAT YOU

AGREE TO THESE TERMS. Do not use AIM if you do not agree to these terms.

1. SOFTWARE. These terms (the “Agreement”) govern your use of the AIM software

libraries that have been bundled into your product (the “Software”). We offer you the

Software provided that you comply with the terms of this Agreement and the terms of

any agreements that apply to your use of the product. We may discontinue or change

any aspect of the Software at any time, with or without notice. We have no obligation to

provide support, corrections or enhancements to the Software.

2. OWNERSHIP AND LICENSE. The Software is protected by copyright, intellectual

property laws and by international treaties. We and our suppliers own all rights in the

Software and we retain and reserve all rights not expressly granted to you. We offer

you a personal, limited, non-exclusive and non-transferable license to install and use

the Software on a single device for personal and internal business purposes during

the term of this Agreement. This license does not entitle you to receive from us hard-

copy documentation, support, telephone assistance, or enhancements or updates to the

Software.

3. RESTRICTIONS. You may not: (a) modify or create any derivative works of the

Software; (b) decompile, disassemble, reverse engineer, or otherwise attempt to derive

the source code, underlying ideas, or algorithms of the Software; (c) try to obtain the

communications protocols from the Software to gain unauthorized access AOL’s networks;

(d) use the Software or any of its components to develop and/or redistribute software or

services to access AOL services; (e) attempt to gain unauthorized access to AOL’s networks

and computers; (f) resell, license or otherwise transfer rights to the Software; (g) remove

or alter any trademark, logo, copyright or other proprietary notices, legends, symbols

or labels in the Software; (h) interfere with any advertising or other functionality of the

Software; (i) use the Software to damage, disable, overburden, or impair AOL’s networks,

computers or services; (j) interfere with any other party’s use and enjoyment of AOL

services; (k) use the Software in any way that violates this Agreement or any law; (l) use

the Software in any way that violates the rights of any third party; (m) use the Software

in any way to transmit, directly or indirectly, any unsolicited bulk communications (such

e-mails, voice, photos, video, chat or SPIM instant messages); or (n) authorize or assist any

third party to do any of the things described in this paragraph.

4. CONTENT. We are not responsible for the content that you may access through the

Software and this Agreement should not be construed as granting any license to use such

content.

5. REGISTRATION. You must register with AOL and obtain an authorized user ID and

password (“User ID”) in order to use the instant messaging services associated with the
