4. LIMITATION OF LIABILITY:
EXCEPT AS STATED ABOVE, NEITHER PANASONIC, PANASONIC’S SUPPLIER
NOR FWB MAKES OR PASSES ON TO YOU OR OTHER THIRD PARTY, ANY
WARRANTY OR REPRESENTATION INCLUDING, BUT NOT LIMITED TO, THE
IMPLIED WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE.
NEITHER PANASONIC, PANASONIC’S SUPPLIER NOR FWB SHALL BE LIABLE
FOR ANY DAMAGE SUFFERED BY YOU INCLUDING, BUT NOT LIMITED TO,
CONSEQUENTIAL, INCIDENTAL SPECIAL OR PUNITIVE DAMAGES. THE ABOVE
LIMITATIONS SHALL APPLY REGARDLESS OF THE FROM OF ACTION
WHETHER INCONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT
LIABILITY OR OTHERWISE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
5. U.S. Government Restricted Rights
The SOFTWARE and documentation are provided with RESTRICTED RIGHTS. Use,
duplication or disclosure by the Government is subject to restrictions as set forth in
subparagraph (c){1)(ii) of the Rights in Technical Data and Computer Software clause
at DEARS 252.227-7013 or subparagraph (c)(1) and (c)(2) of the Commercial
Computer Software -- Restricted Rights at 48 CFR 52.227-19, as applicable.

6. U.S. Export Control
You agree and certify that neither the SOFTWARE will be transferred or reexported,
directly or indirectly, into any country where such transfer or reexport is prohibited by
the U.S. Export Administration Act and Regulations thereunder, without the proper
authorization of U.S. Government, if required.
7. Controlling Law
This Agreement is governed by the law of Japan.
