Warranty Duration: One (1) Year, return to GCC or authorized representative
1. GCC Technologies, Inc. (“GCC”) warrants, for the limited period of one (1) year from the date of original purchase, the Elite Color 16 Series Laser
Printer, accessories and supplies (the “Product”) to be free from defects in materials and workmanship. If such defects are reported to GCC during the
warranty period, GCC or its authorized representative will, at its option, repair, replace or refund the purchase price of any defective product at no
additional cost. Defective product, along with a dated proof-of-purchase bearing the serial number of each defective product, must be returned, trans-
portation costs prepaid, to GCC or an authorized GCC dealer or representative during the warranty period to be eligible for warranty service.
1.1 Except as expressly set forth above, GCC makes no other warranties with respect to the Product, express or implied, including but not lim-
ited to, any implied warranties of merchantability or fitness for a particular purpose.
2. GCC warrants, for the limited period of one (1) year from the date of original purchase, the Elite Color 16 Series Printer Software and Documenta-
tion (the “Software”) to be free from defects in materials and workmanship. If you discover physical defects in the medium on which the Software is
distributed, GCC will, at its option, replace the medium at no charge to you or terminate the License and require the return of your Product, and upon
such return, refund to you the purchase price thereof. To qualify for this warranty, you must return the defective medium with proof-of-purchase to
GCC during the warranty period.
2.1. Except as set forth in the immediately proceeding paragraph, GCC provides the Software “AS IS” and without warranty of any kind, either
express or implied, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose, warranties of
quality or performance or warranties of title and noninfringement. You the licensee are assuming the entire risk as to the quality of the software
and the documentation and the results of its use. Your exclusive remedy with respect to the Software shall be limited to the replacement of any
defective medium, or refund of the purchase price of your Product, as set forth above.
2.2. The Software contains components produced by Apple Computer, Inc. and distributed by GCC under license. Apple Computer, Inc. makes
no warranties, either express or implied, regarding the enclosed computer software package, its merchantability or its fitness for any particular
purpose. The exclusion of implied warranties is not permitted by some states. The above exclusion may not apply to you. This warranty pro-
vides you with specific legal rights. There may be other rights that you have which vary from state to state.
3. Under no circumstances shall GCC’s liability arising out of or in connection with the Product or the Software or the inability to use the Product or
the Software, in contract, in tort (including negligence), or otherwise exceed the purchase price of the Product. In no event shall GCC be liable for
direct, consequential, indirect, incidental, punitive, special or other damages including, but not limited to, damages for downtime or lost profits, busi-
ness, use of software or equipment, or goodwill, whether or not GCC has been advised of the possibility of such damages.
4. This Warranty is limited to the original purchaser of the product and is not transferable unless otherwise agreed to by GCC in writing. This War-
ranty does not apply to Product or Software which has been damaged by accident, abuse or misuse, or which has been modified without the prior writ-
ten permission of GCC.
5. The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied. No GCC dealer, agent or
employee is authorized to make any modification or addition to this warranty.
6. Some states do not allow the exclusion or limitation of implied warranties or liability for incidental or consequential damages, or do not allow limi-
tations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. Any implied warranties, including any
implied warranties of merchantability or fitness for a particular purpose, are limited in duration to one year from the date of original purchase of this
product. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
