Software Licence Terms
The following License Terms govern your use of the accompanying software unless you have a separate signed agreement
with Leica Microsystems.
License Grant
Leica Microsystems grants you a license to Use one copy of the Software. "Use" means storing, loading, installing, executing
or displaying the Software. You may not modify the Software or disable any licensing or control features of the Software.
Ownership
The Software is owned and copyrighted by Leica Microsystems. Your license confers no title to, or ownership in, the Software
and is not a sale of any rights in the Software.
Copies and Adaptations
You may only make copies or adaptations of the Software for archival purposes or when copying or adaptation is an essential
step in the authorized Use of the Software. You must reproduce all copyright notices in the original Software on all copies or
adaptations. You may not copy the Software onto any public network.
No Disassembly or Decryption
You may not disassemble or decompile the Software unless Leica Microsystem's prior written consent is obtained. In some
jurisdictions, Leica Microsystem's consent may not be required for limited disassembly or decompilation. Upon request, you
will provide Leica Microsystems with reasonably detailed information regarding any disassembly or decompilation
Transfer
Your license will automatically terminate upon any transfer of the Software. Upon transfer, you must deliver the Software,
including any copies and related documentation, to the transferee. The transferee must accept these License Terms as a
condition to the transfer.
Termination
Leica Microsystems may terminate your license upon notice for failure to comply with any of these License Terms. Upon
termination, you must immediately destroy the Software, together with all copies, adaptations and merged portions in any
form.
Export Requirements
You may not export or re-export the Software or any copy or adaptation in violation of any applicable laws or regulations.
Any person to whom this software is transferred should be aware that use of the software is subject to any Leica
Microsystems software license terms distributed with the software. Use of the software indicates acceptance of these terms.
If the user does not accept these terms, the software should be returned.
Disclaimer of Warranty
Leica Microsystems and its licensors disclaim all warranties, express, implied and statutory including, without limitation, the
implied warranties of merchantability, fitness for a particular purpose, title and non-infringement of third party rights. No oral
or written information or advice given by Leica Microsystems, its dealers, distributors, agents or employees shall in any way
increase the scope of this warranty.
Some jurisdictions do not allow the limitation or exclusion of implied warranties or how long an implied warranty may last, so
the above limitations may not apply to you.
Limitation of Warranty
Leica Microsystems shall not be liable for any incidental, special, consequential or indirect damages of any kind (including
damages for interruption of business, procurement of substituted goods, loss of profits, or the like) regardless of the form of
action whether in contract, tort (including negligence), strict product liability or any other legal or equitable theory, even if
such party has been advised of the possibility of such damages. In no event will Leica Microsystems aggregate cumulative
liability for all claims out of or related to this agreement and software exceed the amounts you paid for software.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages so this limitation and
exclusion may not apply to you.
Warranty disclaimer and limited liability are fundamental elements of the basis of the bargain between Leica Microsystems
and you. Leica Microsystems would not be able to provide the software without such limitations.
