EVITA INSITU/EVITA INLINE: Through conclusion of the system
protection agreement within the first 6 months after purchase the
warranty for defect-related claims is extended in accordance with the
regulations of the system protection agreement. Hach Lange GmbH
offers different system protection agreements with different services and
extensions of the warranty periods.
For defects, to which also counts the lack of assured properties, the
supplier is liable under exclusion of further claims as follows: All parts
must according to the choice of the supplier be improved or supplied
again for free that, within the limitation period calculated from the day of
the risk transfer, are demonstrably unusable as a result of a situation
present before the risk transfer, in particular due to incorrect design,
poor materials or inadequate finish, or whose usability has been
significantly impaired. The identification of such defects must be
reported in writing to the supplier immediately, however at the latest
fourteen days after identification of the fault. If the customer omits this
notification, the performance is considered approved despite the defect.
A further liability for any indirect or direct damages does not exist.
If device-specific maintenance- or inspection work defined by the
supplier is to be performed within the warranty period by the customer
himself (maintenance) or by the supplier (inspection) and these
requirements are not performed, the claim for the damages that have
occurred through the non-observance of the requirements ceases.
Hach Lange is not responsible for any indirect or consequential
damages, for example injury to persons or property,
operational breakdown, including production loss, profit loss, loss of
goods in the warehouse or similar that may result from defects and/or
lead to the delayed deliveries of the sold products, irrespective of the
cause, including defective manufacture, design and material.

Furthermore the warranty does not include:

Wear parts and consumable materials

If the product is damaged because it was not operated/maintained
in accordance with the manual

If the product is damaged due to an incorrect installation or
operation

Damage caused through electrical failure or lightning/overvoltage

Defects that arise through non-cleaning before storage

Defects that arise through use outside the requirements for
transmitters

The following points must (also without a system protection agreement)
be performed by the customer:

The transmitter must be cleaned before each chemical change

with a cleaning tank

Documentation of the performed cleaning and maintenance work

The replacement of a supplied transmitter

The cleaning, packaging and assignment of the return delivery of
the defective transmitter for repair and/or troubleshooting to Hach
Lange

For the avoidance or limitation of consequential damage, it is thus
recommended to design the closed control loop so that the malfunction
of a device automatically effects a switch to the backup control, which
represents the safest operating state for the environment and process.
Unless regulated otherwise above, the general terms of business of
Hach Lange GmbH also apply.
