Echelon OpenLNS Commissioning Tool (CT) Software License Agreement
I. NOTICE
This OpenLNS Commissioning Tool (CT) Software License Agreement (the "Agreement") is enterered
between you ("You" or "Your") and Echelon Corporation ("Echelon"). YOU MUST READ AND AGREE
TO THE TERMS OF THIS AGREEMENT BEFORE DOWNLOADING, INSTALLING, OR USING
THE ECHELON OPENLNS COMMISSIONING TOOL SOFTWARE (THE "LICENSED
SOFTWARE"). BY CLICKING THE "ACCEPT" BUTTON OF THIS AGREEMENT, OR
DOWNLOADING THE LICENSED SOFTWARE, OR INSTALLING THE LICENSED SOFTWARE,
OR USING THE LICENSED SOFTWARE, YOU HEREBY AGREE TO BE BOUND BY THE TERMS
AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE WITH THE TERMS AND
CONDITIONS OF THIS AGREEMENT, PLEASE EXIT THIS PAGE AND DO NOT DOWNLOAD OR
INSTALL OR USE ANY LICENSED SOFTWARE. BY DOING SO YOU FOREGO ANY IMPLIED
OR STATED RIGHTS TO DOWNLOAD OR INSTALL OR USE LICENSED SOFTWARE.
II. LICENSE GRANT
In consideration of Your agreement to the terms of this Agreement, Echelon grants You a non-exclusive,
non-transferable, non-sublicensable license to use the Licensed Software during the Use Period and any
updates or upgrades thereto provided by Echelon during the Maintenance Period according to the terms set
forth below (the “License”).
III. DEFINITIONS
For purposes of this Agreement, the following terms shall have the following meanings:
• "Activate" and "Activation" mean the process of generating a Valid License for a Licensed Device.
During Activation for your Licensed Device the Licensed Software will send information about the
Licensed Software and the Licensed Device to Echelon. By using the Licensed Software you consent
to the transmission of this information to Echelon.
• "Activation Key" means a unique identifier used to identify one or more Valid Licenses. The
Activation Key is free for Trial Editions of the Licensed Software and must be purchased for all other
editions.
• "Documentation" means the documentation included with the Licensed Software.
• "Licensed Device" means a computer, hardware partition, blade, or virtual machine with a Valid
License for the Licensed Software.
• "Licensed Software" means the Echelon OpenLNS Commissioning Tool (CT), Echelon OpenLNS
Server, and associated media, printed materials, and online or electronic documentation. The Licensed
Software includes the Microsoft Visio software included with some editions of the Licensed Software.
• "Maintenance Period" means a time period during which you can install updates and upgrades for the
Licensed Software at no additional charge. The initial Maintenance Period starts upon activation and
continues for the Trial Period after activation for Trial Editions of the Licensed Software and starts
upon purchase of an Activation Key and continues for one (1) year from time of purchase of an
Activation Key for the Licensed Software for all other editions. Echelon may release updates that can
be installed outside the Maintenance Period. The availability of free upgrades does not apply to the
Visio software included with some editions of the Licensed Software.
