• "Trial Period" is a 60-day period during which the Licensed Software can be used with limited
functionality for a maximum of two networks, with a maximum of five devices per network, and a
maximum run time of 60 minutes.
• "Use Period" means a time period during which you can use the Licensed Software. The Use Period is
limited to the Trial Period for Trial Editions of the Licensed Software, and is unlimited for all other
editions Licensed Software.
• "Valid License" means a License authorization generated by Echelon during activation that is specific
to a single Licensed Device.
IV. PERMITTED USE
The License granted in Section II above permits you to:
(a) install and use the Licensed Software during the Use Period on one (1) primary Licensed Device (the
"Primary Computer") for each Valid License for a Trial Edition, and for each pair of Valid Licenses
for all other editions;
(b) remotely access the Licensed Software from another computer or other device provided there is a Valid
License for each simultaneous user;
(c) install and use a second copy of the Licensed Software during the Use Period on one (1) portable
Licensed Device (the "Portable Computer") for each pair of Valid Licenses, provided that (i) the
second copy is for the exclusive use of the individual who is the primary user of the copy of the
Licensed Software installed on the Primary Computer, (ii) the Licensed Software is not a Trial Edition,
(iii) the Licensed Software are not used on the Primary Computer and its associated Portable Computer
at the same time, and (iv) such installation and use otherwise comply with all the terms and conditions
of the Agreement;
(d) install any updates or upgrades for the Licensed Software released during the Maintenance Period;
(e) extend the Maintenance Period for an additional year for one copy of the Licensed Software with a
Valid License by purchasing an Echelon Maintenance Renewal product that Echelon designates covers
the specific edition of the Licensed Software; once extended the Maintenance Period may be extended
again by purchasing an additional Echelon Maintenance Renewal product that Echelon designates
covers the specific edition of the Licensed Software; the Maintenance Period may only be extended
during the Maintenance Period;
(f) install any updates that Echelon identifies as not requiring maintenance coverage at any time during
the Use Period;
(g) copy the Documentation for internal reference use only by any person that has valid access to your
Licensed Device or internal network, provided that You reproduce, unaltered, all proprietary notices on
or in the copy;
(h) make one (1) copy of the Licensed Software in machine readable form solely for backup purposes,
provided that You reproduce, unaltered, all proprietary notices on or in the copy;
(i) physically transfer a copy of the Licensed Software with a Valid License from one (1) computer to
another no more than one time every 90 days or upon hardware failure of the Licensed Device,
provided that such copy is removed from or inaccessible on the computer on which it was previously
installed and such installation and use otherwise comply with all the terms and conditions of the
Agreement; and
(j) transfer Your rights under this Agreement to an end user of the Licensed Software; provided that (i)
You and the transferee execute two copies of the Software License Transfer Agreement included with
the Licensed Software, or an equivalent agreement that you create, (ii) You identify all previous
licensees of the Licensed Software in the Software License Transfer Agreement or your equivalent
agreement, and (iii) You and the transferee each retain one (1) signed original thereof and furnish
