8.2 In no event shall LICENSOR or its suppliers be responsible for any
special, indirect, punitive or consequential damages arising out of the
use of any Licensed Program or in connection with any breach of this
license, even if LICENSOR is advised in advance of the possibility OF
SUCH DAMAGES.
9 ................................................................................................ Miscellaneous
9.1 Limitation of Action—No action arising out of this License, regardless
of form, may be brought by either party against the other more than two
(2) years after the cause of action has accrued.
9.2 Enforceability—Should any provision of this License be held by a court
of law or equity to be illegal, invalid, or unenforceable, the remaining
provisions of the License shall not be affected or impaired thereby.
9.3 Waiver—The failure of any party to enforce any term or condition of
this license shall not constitute a waiver of that party’s right to enforce
any term or condition of this License unless waived in writing.
9.4 Governing Law—This license shall be interpreted and governed by the
law of the State of Connecticut.
9.5 Notices—All notices shall be in writing and sent by registered or
certified mail, return receipt requested. The date notice is received shall
be the effective date.
