(d) Each license issued pursuant to the regulations in this part and parts 31

through 35 and 39 shall be deemed to contain the provisions set forth in
section 183b.-d., inclusive, of the Act, whether or not these provisions
are expressly set forth in the license.

(e) The Commission may incorporate, in any license issued pursuant to the

regulations in this part and parts 31 through 35 and 39, at the time of
issuance or thereafter by appropriate rule, regulation or order, such
additional requirements and conditions with respect to the licensee’s
receipt, possession, use and transfer of byproduct material as it deems
appropriate or necessary in order to:

(1) Promote the common defense and security;

(2) Protect health or to minimize danger to life or property;

(3) Protect restricted data;

(4) Require such reports and the keeping of such records, and to

provide for such inspections of activities under the license as may
be necessary or appropriate to effectuate the purposes of the Act and
regulations thereunder.

(f) Licensees required to submit emergency plans by §30.32(1) shall follow

the emergency plan approved by the Commission. The licenses may
change the approved plan without Commission approval only if the
changes do not decrease the effectiveness of the plan. The licensee shall
furnish the change to the appropriate NRC Regional Office specified in
§30.6 and to affected offsite response organizations within six months
after the change is made. Proposed changes that decrease, or potentially
decrease, the effectiveness of the approved emergency plan may not be
implemented without prior application to and prior approval by the
Commission.

(g) Each licensee preparing technetium-99m radiopharmaceuticals from

molybdenum-99/technetium-99m generators shall test the generator
eluates for molybdenum-99 breakthrough in accordance with 35.204 of
this chapter. The licensee shall record the results of each test and retain
each record or three years after the record is made.
